Huh?  The empty trash icon is not displayed only in the following
circumstances:
1) POP3 is being used
2) Either trash or virtual trash is not being used
3) The empty trash icon config option is off.

There is absolutely no check on whether there is deleted messages in the
current mailbox and/or mailbox page.
