[imp] insuficient privileges

I´m runnig imp 3 and my webserver runs with its own user (apache)
when imp sends a message, it writes the files under /var/spool/mqueue/ being 
owned by user root and group apache
when i send mail to a local user i get:
insuficient privileges to deliver to "user"
but when i change the ownership of the file under /var/spool/mqueue the message 
is delivered correctly.
do i need to change some configuration for procmail?
what i´m missing.
