you are right, i am using the cgi version.

PHP 4.3.3 (cgi) (built: Jan 12 2005 16:09:33) 

i just started reading about the differences, but I don't have the CLI
version installed.

Is it possible you're using a CGI binary, not a CLI binary? (probably 
not, since
mail-filter checks runningFromCLI(), but worth checking).
